Title

Receive a presentation regarding a potential amendment to the Comprehensive Zoning Ordinance related to home occupations.

Body

BACKGROUND:

Back in 2022, the Code Enforcement Department received several complaints about neighborhood issues allegedly caused by the operation of home occupations. This prompted Code Enforcement staff to give several presentations to City Council on the matter. During the Study Session of their October 24, 2023 meeting, City Council was presented with a set of draft regulations for a potential amendment to Chapter 19: Business of the Code of Ordinances.

However, in discussions with the City Attorneys, it was determined that home occupations should be addressed by the Planning Department through an amendment to the Comprehensive Zoning Ordinance (CZO) given this use is already defined here. Hence, Planning staff seeks to streamline the definition of home occupations by presenting this proposed amendment to Article 2 “Zoning Districts and Uses” and Article 2.5 ““Land Uses Requiring Special Performance Standards” by adding subsection “G” titled “Home Occupation”.

The purpose of this agenda item to present to the Commission staff’s proposed ordinance and receive feedback ahead of this being brough back as an action item.

RECOMMENDATION:

Staff recommends the Planning and Zoning Commission provide feedback to staff on the draft home occupation ordinance of the CZO.
