Title

Discuss a potential amendment to the Comprehensive Zoning Ordinance related to expiration timelines for approved site plans.

Body

BACKGROUND:

Section 6.5 of the Comprehensive Zoning Ordinance (CZO) states that a Specific Use Permit (SUP) will expire six months after approval if a building permit or Certificate of Occupancy has not been obtained. The CZO does not have expiration requirements for site plans. Planned Development Districts (PD) may have their own timelines related to plan expirations.

Staff discussed this topic with the City Council at the February 12, 2024, Strategic Planning Session. The Council agreed to add an expiration timeline for site plans. Three years was proposed as an example timeline by the Council, but they were interested in seeing research from surrounding municipalities.

Staff has researched regulations regarding site plan expiration dates in other local municipalities and has proposed a set of initial standards for discussion related to a potential ordinance amendment for Farmers Branch.
