Title

Consider adopting Ordinance No. 3878, approving amendments to Chapter 56, Property Maintenance, of the Code of Ordinances related to property maintenance notices, violations, and filing of liens; and take appropriate action.

Body

REQUESTOR:

Neighborhood Services Department

BACKGROUND:

Language regarding enforcement practices was overwritten in a previous amendment of the Code of Ordinances, Chapter 56, Property Maintenance. Staff reviewed codified amendments with the City Attorney to determine if such language should be re-added. Research was conducted on peer municipalities and state law, and it was found that re-adding the language was necessary to more clearly define Code Enforcement’s enforcement processes and capabilities.

DISCUSSION:

To clarify the enforcement capacity of Chapter 56, Property Maintenance, language will be added utilizing Ordinance No. 3878 regarding issuing notices, violations, and citations. The language also clarifies notices of violation can be given in person, by mail, or by posting at the property. Lastly, language clarifies that the assessment of expenses via liens for abatement costs incurred due to violations found can be utilized.
