BACKGROUND:
On February 7, 2023, the City Council approved Resolution No. 2023-024 authorizing the City Manager to execute an Interlocal Agreement (ILA) with Dallas Area Rapid Transit (DART) for the use of Funds in the amount of $5,935,000 for DART-approved projects that benefit DART's Public Transportation System or provide Complementary Transportation Services as defined by the ILA. On January 28, 2025, the DART Board of Directors approved an amendment to extend critical deadlines, specifically those for contract awards.
DISCUSSION:
Cities within the DART service area are making good-faith efforts to design, award, and complete approved projects per the 2023 ILA. However, member cities have expressed concerns about meeting the deadlines provided in the 2023 agreement.
The deadlines in the current deal are as follows: Projects approved by DART by January 31, 2024, must be awarded by the City by February 28, 2025. Eligible projects must achieve substantial completion by January 30, 2026. Finally, requests for funds must be submitted by April 30, 2026. Funds not duly requested by the City by April 30, 2026, shall be transferred to DART's reserve funds.
After considering the cities' requests, the DART Board of Directors approved critical deadline extensions for Public Transportation Improvements ILAs with qualifying cities.
The new deadlines are as follows: Projects approved by DART by January 31, 2024, must be awarded by the City by August 30, 2025.
