Title

Conduct a public hearing and consider a variance request at 13315 Nestle Dr. and take appropriate action.

Body

PUBLIC HEARING:

Fabiola Melendez, owner of Lot 9 of Pepper Hill Addition and commonly known as 13315 Nestle Lane. The property is located within the One Family Residence District-6 (R-6) zoning district, is requesting a variance to exceed the maximum floor area of 200 square feet permitted for accessory buildings, as specified in Section 2.9.3.h of the City’s Comprehensive Zoning Ordinance (CZO).

EXPLANATION:

The applicant proposes three accessory structures totaling 380 square feet, requiring a variance of 180 square feet. The applicant uses the structures for general household storage and as a playroom, providing enclosed activity space not accommodated within the primary residence.

The proposed accessory structures consist of:

•                     Two detached structures measuring 100 square feet each.

•                     One attached structure measuring 180 square feet.

The structures have setbacks of 3 feet from the rear property line, 5 feet from the north side, and approximately 20 feet from the south side. Each structure is approximately 10 feet tall and complies with applicable height and setback requirements.

Please note: All variances are unique to the property and circumstances to which they were granted.  While past cases can be discussed and referenced, the testimony at the public hearing, the facts provided in the application, staff report and the evidence of a property hardship should be the basis for all decisions made by the Board.

ACTIONS:

1.                     I move to approve the requested variance to the Comprehensive Zoning Ordinance, Section 2.9.3.h to allow the total accessory structure area to exceed the 200-square-foot maximum by 180 square feet.

2.   Any other action desired by the Board.
