Title

Consider approving Resolution No. 2024-098 authorizing the City Manager to execute an Advanced Funding Agreement with the Texas Department of Transportation for the Rossford Street Shared Path on Denton Drive in the amount of $2,813,638; and take appropriate action.

Body

BACKGROUND:

The City has secured federal funding to construct a 12’ wide pathway along the east side of Denton Drive from the southern City limit to Rossford Road. This pathway is part of the Regional Trail System. The goal is to have a 12’ trail along the east side of Denton Drive from the Dallas County line in Carrollton through Farmers Branch, ultimately connecting to existing trails in the Bachman Lake area in Dallas. Besides the pathway being part of the Regional Trail System, portions of the trail were identified in the adopted Trail Master Plan (2015) as locations the City should address to improve pedestrian and cycling movement. A small portion of the Denton Drive multiuse path will be constructed as part of the ongoing Denton Drive utility project. Currently, the project is being designed.

DISCUSSION:

On November 12, 2020, the Regional Transportation Council at the North Central Texas Council of Governments approved the City of Farmers Branch for a Congestion Mitigation and Air Quality grant to fund the construction of pedestrian and bicycle improvements along Denton Drive. A multi-use path or trail along Denton Drive provides another means of movement or transportation that does not require a motor vehicle. The grant is for construction only, not design. The project's limits are from the southern city limit line to Rossford Street, north of Valley View Lane.

Based on the AFA, the total reimbursable costs from the U.S. Department of Transportation for the project is $2,641,715; however, the City can only receive $2,588,881. For this project, the City is using Transportation Development Credits (TDCs) for its match. TDCs are not real dollars. $119,089 of the total reimbursable costs are Indirect Costs due to the State. The State seeks reimbursement from the U.S. Department of Transportation for these costs. In contrast, the City must pay the Direct State project-related costs as described in the AFA. The Direct State costs are not reimbursable by federal funds. The total Direct State costs the City must pay TXDOT is $52,834. The City will use the Trail Bond Fund to pay for the State-related project costs.

The approval of this AFA and the future project aligns with the 2024 Critical Business Outcomes CB03. An informational memo is attached listing further details.
