Consider adopting Ordinance No. 3262 ordering a special local option election to be held on May 10, 2014 for the purpose of submitting a proposition to the qualified voters of the City for the legal sale of beer and wine for off-premise consumption only and take appropriate action.

BACKGROUND:
In accordance with the Texas Election Code, an application was submitted for a petition to be circulated within the City of Farmers Branch for the purpose of seeking an election on the proposition of whether to permit the legal sale of beer and wine for off-premise consumption only. The petition was returned and filed with the City Secretary within the time required by the Texas Election Code.
DISCUSSION:
Said petition was filed on January 10, 2014 and has been verified as required by the Texas Election Code. Finding that the petition has been timely filed and satisfies all statutory requirements for calling an election on the proposition, the City Council is required by law to order an election on the proposition at its next regular session following thirty (30) days after the filing of the petition.
The next uniform election date on which the proposition may be placed on the ballot for consideration by the qualified voters of the City is May 10, 2014.
RECOMMENDATION:
City Administration recommends adopting Ordinance No. 3262 ordering a special local option election to be held on May 10, 2014 for the purpose of submitting a proposition to the qualified voters of the City for the legal sale of beer and wine for off-premise consumption only.
ACTIONS:
1) Motion to adopt Ordinance No. 3262 ordering a special local option election to be held on May 10, 2014 for the purpose of submitting a proposition to the qualified voters of the City for the legal sale of beer and wine for off-premise consumption only.
2) Motion to deny Ordinance No. 3262 ordering a special local option election to be held on May 10, 2014 for the purpose of submitting a proposition to the qualified voters of the City for the legal sale of beer and wine for off-premise consumption only.
3) Motion to modify to meet the needs of the Council.
4) Motion to table the issue for further study or take no action.
