Consider approving Resolution No. 2017-088 approving the Memorandum of Understanding between the Texas Department of Transportation’s federally-approved Disadvantaged Business Enterprise Program and the City of Farmers Branch; and take appropriate action.

BACKGROUND:
In September of 2015 the Council approved Resolution No. 2015-086 a Local Project Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT). This was for the construction of a pedestrian bridge along the east side of Marsh Lane over Farmers Branch Creek. Currently, the project is in design phase and being reviewed at the State level. State projects require that Cities provide a memorandum of understanding relative to Disadvantaged Business Enterprise (DBE) Program requirements.
DISCUSSION:
As part of the AFA, the City is to establish a Memorandum of Understanding (MOU) with TxDOT in order to comply with the DBE program requirements established. A DBE goal is based on the project’s type of work, location, and size. The State has set a goal of zero for this particular project. However, an MOU is still required to be in place.
RECOMMENDATION:
Administrative Staff recommends approval of Resolution No. 2017-088 approving the Memorandum of Understanding between the Texas Department of Transportation’s federally-approved Disadvantaged Business Enterprise Program and the City of Farmers Branch.

1. I move to approve Resolution No. 2017-088 approving the Memorandum of Understanding between the Texas Department of Transportation’s federally-approved Disadvantaged Business Enterprise Program and the City of Farmers Branch.
2. I move to approve Resolution No. 2017-088 approving the Memorandum of Understanding between the Texas Department of Transportation’s federally-approved Disadvantaged Business Enterprise Program and the City of Farmers Branch, with modifications.
3. I move to table the issue for further study or take no action.
