BACKGROUND:
The purpose of this item is to consider a request from Thomas Cusick Custom Homes, LLC, to extend Permit No. NSF22-0016 for the construction of the single-family home for an additional 180 days to April 7, 2025. The owner of this home is Mayor Terry Lynne, who will recuse himself from this discussion and action on the item.
A permit for 3352 Chaparral Drive was issued to Thomas Cusick Custom Homes to construct a new single-family home on October 5, 2022. New single-family homes are permitted for 18 months to complete construction, and the Chief Building Official (CBO) may extend a permit by 180 days. The general contractor, Thomas Cusick Custom Homes, LLC, was granted the maximum extension allowed by the CBO to October 7, 2024. After the end of the extension granted by the CBO, Council action is required for any additional extensions.
DISCUSSION:
Ordinance No. 3793, Section 105.5.3 Longer Extensions, states that the holder of a permit for which the maximum extension is allowed pursuant to Section 105.5.2 may make an application to the City Council for an additional extension of the permit by submitting such application in writing. The request must demonstrate justifiable cause for the need for such an extension.
Estimated Timeline Provided by Tom Cusick (general contractor):
• Finishes to be installed upon approval of the permit extension.
• Final inspections requested by the end of February 2025, with anticipated completion in March 2025.
FISCAL IMPACT:
Considering the ordinance, the fee associated with extending the permit will be $4,814.73.
• This fee is calculated by the original permit fee divided by 365 days and multiplied by the number of days requested.
