Consider approving Resolution No. 2024-175 authorizing the City Manager to execute a professional services agreement with Teague Nall & Perkins, Inc. for design of the Denton Drive Roadway Improvements Project in the amount of $552,200; and take appropriate action.

BACKGROUND:

On March 19, 2019, the City Council approved an agreement for preliminary design services for Denton Drive in the Station Area and traffic capacity assessment at two intersections in the DART Station Area. The preliminary work was completed and submitted to the North Central Texas Council of Governments (NCTCOG) for federal funding consideration under the Congestion Mitigation Air Quality program. In November 2020, the NCTCOG Regional Transportation Council approved construction funding for this project in the amount of $2,641,715 with the City's required funding of $463,835.00. The limits of the approved project are from the south City limits to Rossford Road, which is one block north of Valley View, and include the construction of a new trail in alignment with the project already in construction on Denton Drive from Pike Street to Dallas Stars’ Driveway.

 

The City is responsible for all design fees and any utility relocation construction costs. In 2023, the City entered into an Inter Local Agreement (ILA) with DART to receive $5,935,000 in funding toward projects that would benefit the DART station area. Due to that additional funding, the project scope will include full roadway reconstruction and reconfiguration, including on-street parking in the southbound lane per form base code and additional utility improvements. Per the ILA, the project must be substantially complete by February of 2026, with final reimbursements occurring in April 2026. 

 

In December 2023, the City Council approved Resolution No. 2023-262 for a contract with Quality Excavation, LLC, for the Denton Drive Infrastructure Improvement Project. The project included water, sewer, and storm sewer improvements, reconfiguring a portion of Denton Drive from Pike Street to Farmers Branch Lane to meet the PD-86 requirements, and construction of a portion of the Denton Drive trail.

 

DISCUSSION:

The NCTCOG funding for the trail portion of the project has a timeline of completion in 2027, whereas the ILA-funded projects must be substantially complete by February 2026. Due to the more accelerated timeline of the ILA, all portions of the project associated with that funding will be designed and bid out separately within the next six months. The Public Works department is requesting this professional services agreement to incorporate all services within the ILA funding, including boundary verification and boundary survey, engineering to construct full roadway improvements, drainage improvements, and waterline improvements along the project limits.

 

The City and Teague Nall and Perkins, Inc. (TNP) have negotiated a professional services agreement for the Denton Drive Roadway Improvements project in the amount of $552,200. The Engineer’s Opinion of Probable Construction Cost (OPCC) for this project is $4,061,000. The design fee ranges from 10% to 15% of the OPCC. The design fee for this project is $552,200, which is approximately 13% of the total cost. The construction cost will change once the competitive sealed bids are received in the future.

 

FISCAL IMPACT:

Budgeted $552,200 from the Public Works DART Transportation Reimbursement Phase 1 CIP project.
