Title

Consider approving Resolution No. 2025-176 authorizing the City Manager to execute a contract with Rebcon, LLC, for the West Side Art Trail Phase 1 project in the amount of $5,494,832, with the majority of costs being reimbursable through grant funding; and take appropriate action.

Body

REQUESTOR:

Public Works Department

BACKGROUND:

The West Side Art Trail has been a long-term initiative, in development for nearly a decade. The 2015 Trail Master Plan first identified the need for a connection between the City’s central area and the west side, outlining potential strategies to achieve this goal.

The West Side Art Trail is a collaborative public-private initiative designed to develop a 12-foot-wide multi-use trail connecting the City of Farmers Branch DART light rail station with the Campion Trail in Irving. The trail is planned for completion in two phases. Phase 1 encompasses three segments, identified on the attached West Side Art Trail Alignment Map as “Area 1 Alignment”, “Area 3A Alignment”, and “Area 3B Alignment.”

DISCUSSION:

The Engineer’s Opinion of Probable Construction Cost (OPCC) for Phase 1 is $5,558,001. There are several funding mechanisms for this project. Below is an overview of the funding sources:

                     Federal Funds via TxDOT:

$4,545,725 through an Advanced Funding Agreement (AFA) executed initially in 2019. The AFA was updated in 2020, amended in 2021, and further amended in 2024. Under this agreement, the City initially funds project expenses and submits reimbursement requests to TxDOT, which requires strict oversight procedures and detailed checklists to ensure compliance with state and federal standards.

                     Dallas County:

Up to $1.5M as outlined in the Dallas County Funding Agreement.

                     City’s Monetary Contributions:

Up to $1.5M match with Dallas County

$22,729 Local Government Contribution per AFA (paid in 2021).

                     City’s Non-Monetary Contribution:

Transportation Development Credits (TDCs) are used in lieu of 20% financial participation. The City avoids a $909,145 cash match by utilizing TDCs, allowing federal funds to cover most or all project costs, thereby minimizing or eliminating the City's contribution.

The City advertised the project in May 2025, with bids opened on July 10, 2025. Two bids were received. Rebcon, LLC submitted the lowest bid. Rebcon, LLC is currently working on the Denton Drive project and recently completed the Rawhide Culvert Box Repair project, both with strong performance and communication.

Low Base Bid: Rebcon, LLC: $5,494,832

High Base Bid: Axis Contracting, Inc: $6,293,151

The total cost of the project is $5,494,832.  Funds are available in the FY 2025-2026 Non-Bond CIP - West Side Art Trail (Phase 1) Project, and the Trail Improvements Bond CIP - Trails and Sidewalks Project.

DISTRICT:

District 3

FISCAL IMPACT:

Up to $1.75M utilizing current CIP budget for Dallas County match, Local Government Contribution (already paid), and Construction Services Agreement.

No additional financial impacts are anticipated, barring unforeseen project overruns.
