BACKGROUND:

Kimley-Horn and Associates Inc. has been engaged for the West Side Art Trail project for nearly a decade, providing professional services and ensuring continuity throughout its planning and design phases. As the project now advances towards the construction phase, additional professional services are required to assist the City in oversight, coordination, and documentation. This agreement is an important investment that helps safeguard the City’s eligibility for over $4.5 million in federal reimbursements by ensuring compliance with TxDOT requirements.

 

DISCUSSION:

This agreement would authorize Kimley-Horn to provide construction phase services, ensuring the City receives comprehensive engineering support during project delivery. Their scope of services includes responding to contractor inquiries, reviewing shop drawings, evaluating substitutions, attending a preconstruction meeting and monthly progress meetings, and assisting with payment application reviews and construction schedule evaluations. Kimley-Horn will also coordinate closely with City staff, contractors, franchise utilities, and TxDOT, while providing support with change orders as needed.

 

To protect the City’s interests during construction, Kimley-Horn will conduct regular site visits, prepare observation reports, and facilitate substantial and final completion walkthroughs. They will also prepare record drawings documenting as-built conditions, assist with dispute resolution, and support project documentation to ensure compliance with TxDOT’s Local Government Project Procedures (LGPP). These services are critical to meeting TxDOT’s stringent requirements and securing over $4.5 million in federal reimbursements for the project.

 

The agreement authorizes services on an hourly and reimbursable basis not to exceed $225,000, with the City billed only for actual hours worked and expenses incurred. Kimley-Horn’s long-standing involvement with the West Side Art Trail, combined with its expertise in TxDOT compliance, provides the City with the continuity and professional oversight needed to deliver the project successfully, which will help ensure reimbursement of federal funds.

 

There is also an opportunity to offset some of the Construction Services Agreement costs through the Dallas County Funding Agreement, which allows for a 50% reimbursement on up to $131,000 of the total $225,000. This reimbursement could amount to up to $65,500, or approximately 29% of the overall expenses, further reducing the City’s net investment in these services.

 

The total cost of the agreement is $225,000.  Funds are available in the F-Y 2025-2026 Non-Bond CIP - Trail Improvements Project, and the Trail Improvements Bond CIP - Trails and Sidewalks Project.

 

FISCAL IMPACT:

Up to $225,000 utilizing current CIP funds.
