Receive a presentation to review and discuss potential amendments to City Code provisions addressing the screening, visibility, and storage of residential rollout trash and recycling containers.

BACKGROUND:
Rollout containers (residential trash bins and recycling containers) are governed under Chapter 56, Article VI “Outside Storage”, Sec. 56-61 “Declared a Public Nuisance and Prohibited”, of the City’s Code of Ordinances, as to the location for rollout containers when not set out for collection.
Concerns have been raised related to the visibility of rollout containers from streets in residential areas and the possible need to screen them when not set out for collection.
DISCUSSION:
Article VI “Outside Storage”, Sec. 56-61 “Declared a Public Nuisance and Prohibited”, specifies that rollout containers are exempt from being declared a public nuisance if meeting certain criteria. These exceptions include:
1. Containers stored with their lids completely closed at all times and not stored between any portion of the residence and an adjacent public roadway; or
2. When placed at the curb for collection no earlier than 6:00 p.m. on the day prior to collection and removed from the curb no later than 9:00 a.m. on the day after collection.
3. Placed at the curb for collection.
The above criteria related to the allowable location for rollout containers when not placed out for collection delegates them to the side yard or rear yard.
Various placements of rollout containers have been observed throughout the community when not set out for collection, depending on whether the residential subdivision is a front or rear entry product. These placements include:
1. Between the residence and the street, on driveways,
2. The side yard on paved or unpaved surfaces,
3. Between the alley and the back of the residence on driveways,
4. Between the rear fence and the alley, and
5. Inside the back yard/inside the garage.
Research of five nearby municipalities related to the placement of stored rollout containers revealed that three of five municipalities prohibit stored rollout containers between the front of the residence and the street, and one of five municipalities requires them to be screened. In addition, four of five municipalities provide location criteria for stored rollout containers when serviced from an alley.
The City Council will discuss the matter presented and provide policy directions to staff regarding future actions.
