Consider approving Resolution No. 2024-079 canvassing and declaring the election results of the May 4, 2024, Special Election regarding adopting amendments to the City Charter; and taking appropriate action.

BACKGROUND:

The City of Farmers Branch held a Special Election on May 4, 2024, to consider the approval of amendments to the City Charter. The tabulation of votes cast to be canvassed is outlined below. By approving Resolution No. 2024-079, this action will officially canvass the election results of the May 4, 2024 Special Election for Charter amendments.

 

 

PROPOSITION D - Shall Article I, Section 1.08 of the Home Rule Chater be amended by amending the current language regarding the City’s right to acquire real property through the exercise of eminent domain to authorize the exercise of such right for all municipal and public purposes to the extent allowed by, and in compliance with, State law.

 

For: 48.33%

Against: 51.67%

 

PROPOSITION E - Shall Article II, Section 2.03 (a) of the Home Rule Charter be amended to provide a monthly stipend of $400 per month for the Mayor and a monthly stipend of $200 per month for each council member.

 

For: 53.48%

Against: 46.52%

 

PROPOSITION F - Shall Article II, Section 2.14 of the Home Rule Charter be amended to clarify the required vote of the City Council for passage of an item and that an abstention is neither an affirmative or negative vote.

 

For: 74.54%

PROPOSITION G - Shall Article III, Section 3.01 of the Home Rule Charter be amended to authorize the City Council to determine the time period by which the City Manager must become a resident within the City.

 

For: 74.54%

PROPOSITION H - Shall Article III, Section 3.02 (3) of the Home Rule Charter be amended to remove the specific number of days within which the City Manager must submit the fiscal year financial report to the City Council to be consistent with State law.

 

For: 61.74%

Against: 38.26%

 

PROPOSITION I - Shall Article VI, Section 6.06 and Section 6.07 be deleted being redundant with other Sections of the Charter and Section 6.01, Section 6.02 (b) be amended to be consistent with State law and Section 6.08 be amended to be consistent with State law and be renumbered as Section 6.06.

 

For: 79.04%

Against: 20.96%

 

PROPOSITION J - Shall Article VII, Section 7.02 of the Home Rule Charter, be amended to correct an erroneous numerical reference.

 

For: 83.18%

Against: 16.82%

 

PROPOSITION K - Shall Article VII, Section 7.03 of the Home Rule Charter regarding the nomination by petition of a person as a candidate for City Council be amended to provide for use of the petition form prescribed by the Texas Secretary of State to be consistent with State law.

 

For: 78.66%

Against: 21.34%

 

 

PROPOSITION L - Shall Article VII, Section 7.06 of the Home Rule Charter be amended to clarify consistent with State law for which members of the City Council qualified voters are entitled to vote following the implementation of single member district Council representation.

 

For: 78.11%

Against: 21.89%

 

PROPOSITION M - Shall Article IX, Section 9.20 of the Home Rule Charter be amended to require the City Council to appoint a Committee to review the Charter at least every five (5) years, beginning in 2028, and the Charter committee be appointed not later than July 1 of the year in which the committee is required to be appointed.
