Discuss a revision to Article I, Section 1.07 “General Powers Adopted” of the City’s Charter and consider approval of the recommended amendment to the City Council.

BACKGROUND:

At the January 21, 2026, Charter Review Committee meeting, the Committee discussed revising Section 1.07 “General Powers Adopted” to simplify the language and correct grammatical errors. The City Attorney has proposed the following amendment to the Section:

Sec. 1.07. - General powers adopted.

 

The enumeration of particular powers in the Charter shall not be held or deemed to be exclusive, but in addition to the powers conferred upon the City by law and constitution.

The enumeration of particular powers in the Charter shall not be held or deemed to be exclusive, but in addition to the powers conferred upon the City by law and constitution enumerated herein, implied thereby to appropriate to the exercise thereof, the City shall have and may exercise all other powers which, under the constitution and laws of the State of Texas, it would be competent for the Charter specifically to enumerate. The City of Farmers Branch shall have and exercise all the powers conferred upon cities by what is known as the Home Rule Amendment to the constitution of the State of Texas and the enabling act relative thereto, passed by the Thirty-Third Legislature of the State of Texas, found in the published laws of said Legislature, Regular Session, pages 307 to 317, and effective July 7, 1913, and all other laws passed [by] the legislature of the State of Texas, relating thereto, or which may hereafter be passed by said legislature in relation to such matters.

 

DISCUSSION:

The Committee will discuss whether to finalize approval of this recommendation to the City Council.

1.  I move to approve recommending the proposed amendment to the City Council as presented.

2. I move to approve recommending the proposed amendment to the City Council, with modifications.

3.  I move to table the issue for further study or take no action.
