BACKGROUND:
In 1978, the United States Environmental Protection Agency (EPA) published a rule that established mechanisms and procedures for enforcing National Pretreatment Standards controlling the introduction of wastes from non-domestic sources into Publicly Owned Treatment Works (POTWs). Federal regulation 40 Code of Federal Regulation (CFR) 403 requires that a pretreatment program be developed for POTWs.
DISCUSSION:
The City of Farmers Branch contracts with the Trinity River Authority of Texas (TRA) for the transportation and treatment of wastewater, as well as pretreatment and laboratory services. TRA recently modified its pretreatment permit with the Texas Commission on Environmental Quality (TCEQ) to comply with new regulations. This modification impacts all cities that contract with TRA for wastewater collection, treatment, and pretreatment services. To meet the requirements of the contract, Farmers Branch must modify and continue the existing pretreatment program in accordance with the agency’s new pretreatment program permit.
One of the requirements of the TRA permit, in addition to the enacted ordinance stipulating the City regulations, including the enforcement mechanisms for the National Pretreatment Standards, is the approval of a resolution endorsing the continued funding of the pretreatment program. This agenda item satisfies the funding endorsement requirement dictated by TCEQ.
FISCAL IMPACT:
Annual budget associated with permitting and enforcement for FY 24-25 is $23,100.
