BACKGROUND:

On March 19, 2019, the City Council approved Resolution No. 2019-032 authorizing a professional services agreement for preliminary design services for Denton Drive in the Station Area and traffic capacity assessment at two intersections in the DART Station Area. The initial work was completed and submitted as part of a grant application to the North Central Texas Council of Governments (NCTCOG) for federal funding consideration under the Congestion Mitigation Air Quality program. In November 2020, the NCTCOG Regional Transportation Council approved construction funding for this project for $2,641,715 with the City's required funding of $463,835. The limits of the approved project are from the south City limits to Rossford Road, which is one block north of Valley View Lane, and include the construction of a new trail in alignment with the project already in construction on Denton Drive from Pike Street to Dallas Stars’ Driveway

 

In December 2020, the City Council approved Resolution No. 2020-182, executing a professional services agreement with Teague Nall and Perkins, Inc. (TNP) for $310,200 for the trail design.  In 2022, Staff was notified of potential funding from the Texas Department of Transportation (TxDOT) and NCTCOG after the project was originally awarded to TNP for design. Those were the two AFAs that were taken to the Council in June 2024 for approval. The Denton Drive AFA was approved, but the Valley View AFA was denied. Both AFAs required road reconfiguration as part of the design scope. Now that we have the Council’s direction regarding the design scope, the engineers can move forward with finishing the design plans for this project. 

 

 

In December 2023, the City Council approved Resolution No. 2023-262 for a contract with Quality Excavation, LLC for the Denton Drive Infrastructure Improvement Project. The project included water, sewer, and storm sewer improvements and reconfiguring a portion of Denton Drive from Pike Street to Farmers Branch Lane. The project also includes constructing a portion of the trail with the project area, thus reducing the amount of trail that will be constructed in accordance with the approved Advance Funding Agreement for the Denton Drive Multiuse Path.

 

In June 2024, the City Council approved the Advanced Funding Agreement for the Denton Drive Multiuse Path, and the design has progressed. The City is responsible for all design fees and any utility relocation construction costs.

 

DISCUSSION:

City staff and TNP have met with the TxDOT staff to discuss the design, bidding, contract award, and construction process, as well as design considerations and requirements for the project due to the federal funding source. Based on this information and clarification, TNP notified the City of an increase in the Scope of Services for the project. Due to the federal funding component, additional effort will be needed to meet TxDOT’s 30%, 60%, 90%, and final design submittal requirements.

 

The Engineer’s Opinion of Probable Construction Cost (OPCC) for this project is $1,028,000. The design fee ranges from 10% to 15% of the OPCC. The design fee for this project is $183,955, which is approximately 17% of the total cost, and will be funded via the City’s DART Transportation Reimbursement Phase 1 CIP project. The construction cost will change once the competitive sealed bids are received in the future. The fee is higher due to additional tasks required by TxDOT.

 

The City, Teague Nall, and Perkins, Inc. have negotiated a $183,955 amendment for the Denton Drive Trail Connector project.

 

FISCAL IMPACT:

Budgeted $183,955 from the Public Works DART Transportation Reimbursement Phase 1 CIP project.
