Consider appointing a qualified candidate to fill the position of Mayor for the unexpired term ending May 2023, or consider adopting Ordinance 3778 calling a special election for January 21, 2023 for the purpose of electing a person to fill the vacancy for the unexpired term for Mayor; and take appropriate action.

BACKGROUND:
The resignation of Mayor Robert Dye was submitted on October 31, 2022 and became effective eight (8) days later, November 8, 2022, creating a vacancy for the office of Mayor.
The City Council has the following options available to fill the vacancy for the office of Mayor:
1. Appoint a candidate to fill the unexpired term for Mayor until May 2023 meeting all the qualifications of a City Council candidate.
2. Call a special election within 120 days to fill the vacancy for Mayor for the unexpired term ending May 2023.
The vacancy for Mayor has an unexpired term of less than one year remaining on the current term ending May 2023. City Charter, Section 2.04 states vacancies occurring in all Council positions shall be filled by a special election to be held within one hundred twenty (120) days after the vacancy occurred, or a vacancy on the Council may be filled by appointment by the Council if the vacancy created is for an unexpired term of office of twelve (12) months or less. The Council member thus elected or appointed shall serve for the unexpired portion of the vacated position.
An Ordinance has been prepared allowing for a special election to be called should the Council consider not appointing a candidate to fill the unexpired term. The special election to fill the vacancy for Mayor would coincide with the special election that was previously called for January 21, 2023 to fill the unexpired term for District 3. The election would be administered by the Dallas County Elections Administration in accordance with the Texas Election Code and the City Charter.
