BACKGROUND:
A Municipal Setting Designation (MSD) is a regulatory tool authorized under Texas law that allows municipalities to support the redevelopment and productive use of properties affected by historical groundwater contamination that is not being used as a source of potable water. By applying for an MSD, the City can facilitate economic development and investment while ensuring that public health is protected by restricting the use of designated groundwater. The designation provides regulatory certainty for property owners, developers, and environmental agencies, promotes the reuse of underutilized properties, and supports the City's long-term redevelopment and economic development objectives.
The property located at 1349-1399 Valley View Lane, formerly the City of Farmers Branch Citizen Collection Center, is currently vacant. The site has been the subject of multiple environmental assessments, which identified groundwater constituents of concern (COCs), including semi-volatile organic compounds (SVOCs), per- and polyfluoroalkyl substances (PFAS), and Resource Conservation and Recovery Act (RCRA) 8 metals.
As an alternative to groundwater remediation, the City may pursue a Municipal Setting Designation (MSD) through the Texas Commission on Environmental Quality (TCEQ). An MSD prohibits the use of designated groundwater as potable water within the approved area, allowing the property to remain suitable for redevelopment while protecting public health.
