Consider adopting Ordinance No. 3248 abandoning a portion of Bee Street and Pepperwood Street right-of-way for use in conjunction with Mustang Station and take appropriate action.

BACKGROUND:
The Mustang Station development is located east of the DART rail station and bounded by Pike Street, Bee Street, Pepperwood Street, Charlie Bird Parkway, and Bill Moses Parkway. A portion of the Mustang Station building near the intersection of Pepperwood Street and Bee Street was designed to include a porte cochere (carriage porch) that extends from the main entrance of the building into the street right-of-way. The porte cochere serves to shelter the driveway to the main building entrance. The porte cochere area includes the drive overhang, a monument sign, landscaping, and ornate paving surfaces within a 179 square foot area. The porte cochere structure area is architecturally attached to the Mustang Station and will be used for drop off and delivery.
DISCUSSION:
A right of way use agreement was originally proposed for the placement of the porte cochere in the street right-of-way. However, due to the ultimate extent of improvements proposed for construction, the City Attorney recommends partial abandonment of the right-of-way in lieu of a right-of-way use agreement. The partial abandonment of the right-of-way facilitates the building structure but reserves for the City and other public franchise utilities a general utility easement.
RECOMMENDATION:
The City Attorney and City Administration recommend adopting Ordinance No.3248 abandoning a portion of Bee Street and Pepperwood Street right-of-way for use in conjunction with Mustang Station.
