BACKGROUND:
On July 14, 2009, City Council authorized the City Manager to enter into a contract with McElroy, Sullivan, & Miller, L.L.P. for legal services relating to a permit amendment to expand the Camelot Landfill.
DISCUSSION:
During the permitting process for the expansion, the City of Lewisville, Texas filed a civil lawsuit in federal court against the City of Farmers Branch and Camelot Landfill, TX, L.P., the landfill operator. The civil lawsuit is outside of the contractual scope of services. Because the civil lawsuit pertains to the expansion of Camelot Landfill, the legal services contract with McElroy, Sullivan, Miller, Olmstead, & Weber, L.L.P., formerly McElroy, Sullivan, & Miller, L.L.P., must be amended. This task will include legal representation of Farmers Branch in the lawsuit and any related appeals. This would be the first amendment to the contract.
This item is consistent with Core Value #5 providing functional, sustainable, and well maintained infrastructure, facilities, and equipment.
RECOMMENDATION:
City Administration recommends approving Resolution No. 2013-015 amending the contract for legal services with McElroy, Sullivan, Miller, Olmstead, & Weber, L.L.P. relating to Camelot Landfill.
