Consider approving Resolution No. 2025-028 authorizing the City Manager to execute an updated Advance Funding Agreement with the Texas Department of Transportation for the Valley View Lane and Mercer Parkway Pedestrian Crossing with the City's contribution of $55,804; and take appropriate action.

BACKGROUND:
Resolution No. 2024-216, approved in November 2024, authorized an Advance Funding Agreement (AFA) between the City and the Texas Department of Transportation (TxDOT) for the installation of a pedestrian crosswalk at the intersection of Valley View Lane and Mercer Parkway.
Upon approval, the agreement was sent to TxDOT for signature. TxDOT requested some minor adjustments to the AFA and a revised resolution for the AFA. Those changes include:
* Remove the total project budget cost from the Resolution per TxDOT's request. However, the total project budget estimate will be reflected in Attachment B of the AFA, not the resolution.
* Remove standard language stating that the City is using Transportation Development Credits (TDCs), as the City is not utilizing TDCs for this project.
* Remove 'Exhibit A,' which was a copy of the AFA, from the Resolution to avoid duplication of information.
* Added a line stating that the City is responsible for overruns.
DISCUSSION:
In March 2023, the City Council approved Resolution 2023-077, supporting the City's application to the Texas Department of Transportation (TxDOT) 2023 Transportation Alternatives Set-Aside (TA) Call for Projects for the Valley View Lane and Mercer Parkway Pedestrian Crosswalk. The application was approved. The project is moving to the next step, which requires Council approval of the Advance Funding Agreement (AFA). The AFA funding is for construction only. Project design is covered under a separate contract with Kimley-Horn, funded solely by the City.
