BACKGROUND:
In 2024, the City Council collaborated with the homeowner's association and staff to alleviate homeowners' responsibilities for maintaining the medians along Mercer Parkway and Wittington Place in the Mercer Crossing subdivision. As part of the Fiscal Year 2025 budget, the City Council approved the staffing and equipment for the City to begin taking over the median maintenance in 2025.
DISCUSSION:
In late 2024, staff began working with the City Attorney and Essex Management Company (the homeowners' association management company) on amending the current maintenance agreement for the medians, which would allow for the transfer of maintenance responsibility for the medians from the homeowners to the City. Within the agreement, there will be items that the City requires of the homeowner's association as part of the takeover. Updating the current landscape, making a payment of $120,000, and moving all irrigation systems from the homeowners to the City are the highlights of the current proposed agreement.
Once both parties approve the agreement, the City will determine an impending takeover date. As stipulated in the agreement, the City can begin to work with the homeowner's association on the transition process immediately after the agreement has been executed.
FISCAL IMPACT:
The Fiscal Year 2025 budget included expense funding for staffing and equipment and receipt of revenues of $120,000 from the homeowner's association.
