Title
Conduct a public hearing and consider adopting Ordinance No. 3838 for a multifamily development on approximately 2.49-acres located at 12055 Luna Road, described as Lot 2, Block A, Royal Hospitality Addition, within the Planned Development District No. 88 (PD-88) zoning district; and take appropriate action.

Body
BACKGROUND:
The applicant, Blaze Bownds, P.E. Kimley-Horn, requests to amend Planned Development District No. 88 (PD-88) with special exceptions for a new multifamily development at 12055 Luna Road. The proposal includes a seven-story multifamily building comprising 145 residential units on top of a two-level podium parking garage.

Multifamily use is permitted by right in PD-88 within the Urban Commerce subdistrict. However, a zoning amendment with a Specific Use Permit (SUP) and associated site plan for a hotel was adopted into the PD-88 ordinance for this site in 2015 (Ord. 3326) and later revised in 2017 (Ord. 3421). A zoning amendment is required because the proposed multifamily use does not align with the adopted site plan for a hotel. If the multifamily request is approved, the applicant plans to begin construction later this year (2024).

RECOMMENDATION:
During the November 13, 2023, Planning and Zoning (P&Z) Commission meeting, the consideration of this case was tabled to the December 11, 2023, meeting, affording sufficient time for staff to examine the concerns raised by the (P&Z) Commission. Subsequently, on December 11, 2023, the P&Z Commission recommended denial of this request by a vote of 4-3. It is noteworthy that despite the P&Z Commission's recommendation for denial, this does not mandate the three-fourths (super majority) requirement, should the City Council approve the request.

POSSIBLE COUNCIL ACTION:
1. I move to approve Ordinance No. 3838 as presented.
2. I move to approve Ordinance No. 3838 with modifications.
3. I move to deny Ordinance No. 3838.
4. I move to ...
