Conduct a public hearing and consider adopting Ordinance No. 3301 amending a Specific Use Permit to allow for beer and wine sales for off-premises consumption and a vehicular fuel station for Lot 1, Block 1, Exxon No. 6-2649 Addition, commonly known as 13115 Stemmons Freeway, located within Planned Development No. 24 (PD-24) zoning district and take appropriate action.

BACKGROUND:
In June of this year, the City of Farmers Branch passed Ordinance No. 3283 to allow beer and wine sales by right in specific overlay locations throughout the City. The Ordinance also amended PD-24 to allow beer and wine sales with a Specific Use Permit (SUP). Therefore, the applicant is seeking to amend their existing SUP for the Shell fuel station, located on the southwest corner of Valley View and Stemmons Freeway to include the sale of beer and wine.
RECOMMENDATION:
On August 25, 2014, the Planning & Zoning Commission voted NOT to recommend approval of the amended Specific Use Permit as described in Ordinance No. 3301.
ACTIONS:
1) Motion to approve Ordinance No. 3301 amending a Specific Use Permit to allow for beer and wine sales for off-premises consumption and a vehicular fuel station for Lot 1, block 1, Exxon No. 6-2649 Addition, commonly known as 13115 Stemmons Freeway, located within Planned Development 24 (PD-24) zoning district.
2) Motion to deny of the Ordinance No. 3301 amending a Specific Use Permit to allow for beer and wine sales for off-premises consumption and a vehicular fuel station for Lot 1, block 1, Exxon No. 6-2649 Addition, commonly known as 13115 Stemmons Freeway, located within Planned Development 24 (PD-24) zoning district.
3) Motion to approve with modifications to Ordinance No. 3301.
4) Motion to continue discussion of this case to the next meeting.
