Consider approving Resolution No. 2013-037 authorizing the City Manager to execute an amendment to the landfill engineering services contract with Weaver Boos Consultants LLC - Southwest relating to the City's TCEQ application to amend the City's solid waste permit for operation of the Camelot Landfill and take appropriate action.

BACKGROUND:
The City entered into a professional services contract with Weaver Boos LLC-Southwest for landfill engineering services in April 2009. The City filed a permit amendment application to expand the disposal volume at Camelot Landfill in March, 2012. During the course of the permitting process, the City of Lewisville, Texas filed a lawsuit in federal court in attempt to stop operations at the facility and to prevent the expansion process from proceeding.

To date, Weaver Boos has designed and permitted the amendment application. If the City of Lewisville pursues the lawsuit in a court of law, representatives from Weaver Boos will have to provide documentation and expert testimony regarding the allegations in the lawsuit. In addition, Weaver Boos is providing professional services for the permitting of a slurry wall at Camelot Landfill. Therefore, the scope of services of the contract and the cost of the contract must be amended.

The total budgeted cost of these services is $285,000, thus increasing the maximum contract amount to $2,174,400.00. The 2012-2013 fiscal year budget was amended at mid-year to account for these potential costs.

DISCUSSION:
The current contract was for the design and permitting of the amendment application. It does not include work required to defend the City in a lawsuit. Because the lawsuit was filed in December 2012, an adjustment was approved in the 2013 mid-year budget to cover the potential costs for engineering services and expert testimony to defend the City.
