Consider adopting Ordinance No. 3773 removing garage sale regulations from the Sales Code (Chapter 58) and the Sign Code (Chapter 62), and creating new garage sale regulations, including a registration requirement, in the Business Code (Chapter 26); and take appropriate action.

BACKGROUND:
Currently, Chapters 58 and 62 both regulate garage sales, though they contradict each other with respect to one or more specific regulations. Homeowners and occupants have difficulty finding garage sale regulations in these codes because the topic is not intuitive to signs or sales, which typically relate to professional business activities, not home-based activities. The existing contradiction(s) can lead to unsuccessful enforcement efforts.
The Code Enforcement Division of Neighborhood Services also observed an uptick in garage sale complaints in calendar year 2022. The most common complaint was the number of sales being conducted at particular addresses. Though the law currently limits an occupant to two garage sales in a calendar year, the Code Enforcement Division lacks a formal methodology to track/count garage sales and hold violators accountable.
By eliminating garage sale regulations from Chapters 58 and 62 and re-creating them in Chapter 26, Code Enforcement believes that garage sale regulations will be:
* Free of contradictory language
* Easier to find when needed by the public
* Easier to enforce when needed by Code Enforcement staff
The matter of tracking/counting garage sales will be resolved with the new registration requirement created by this ordinance, if adopted.

RECOMMENDATION:
City administration recommends approving Ordinance No. 3773 as submitted.
