PUBLIC HEARING:
Jacob and Lindsay Fleming, owners of Lot 4 Block J of Brookhaven Estates 5, more commonly known as 13435 Briarbrook Drive, are requesting permission to encroach the required 25-foot front yard setback by 0.4 feet. The Comprehensive Zoning Ordinance, Article B.3.5, requires a minimum 25-foot front yard setback.
EXPLANATION:
The applicant is requesting the variance due to construction tolerances. During construction, the weight of the cement can move boards out of alignment.
Just an informational note regarding variances: All variances are unique to the property and circumstances to which they were granted. While past cases can be discussed and referenced, the testimony at the public hearing, the facts provided in the application, staff report and the evidence of a property hardship should be the basis for all decisions made by the Board.
ACTIONS:
1. I move to approve the requested variance to the Comprehensive Zoning Ordinance, Article B.3.5 to allow a 0.4 foot encroachment of the required front yard setback.
2. Any other action desired by the Board.
