Conduct a public hearing and consider a request to approve the final plat of Landon Valley View Addition, Lots 1 and 2, Block A, and consider approving Resolution No. 2013-061 authorizing the City Manager to execute a Partial Release of Developer's Contract affecting said property, and take appropriate action.

BACKGROUND:
Valley View Land Partnership, Ltd and 1861 Valley View Investors, LP are the owners of 9.695 acres of land situated on the north side of Valley View Lane between Hutton Drive and Keenan Bridge Road, presently platted as Lot 2, Block A, Valley View Business Center Addition and Lots 1 and 4, Block A, Landon Commerce Center Addition. The property is presently affected by a developer's contract that requires certain public infrastructure improvements to be constructed for the development of those lots.

DISCUSSION:
The property owners propose to re-plat the property as Landon Valley View Addition, Lots 1 and 2, Block A, for the purpose of selling the developed Lot 2. The owners have also requested the City release Lot 2 from the infrastructure requirements defined in a developer's contract that affects the proposed plat. City Administration has reviewed the developer's contract and determined that the contract requirements for Lot 2 have been met and may be released. However, City Administration recommends that Lot 1 of the proposed re-plat should remain affected by all requirements of the developer's contract until such time as it is developed.

The proposed final plat of Landon Valley View Addition, Lots 1 and 2, Block A was approved by the Planning and Zoning Commission on October 14th, 2013 and is consistent with the Texas Local Government Code and with the City's platting requirements.
