BACKGROUND:

The Alcoholic Beverage (On-Premise) Overlay District (“AB-OP”) was established as Article 5.6 of the Comprehensive Zoning Ordinance (CZO) via Ordinance No. 3446 in 2017 with the 2 existing districts being located within The Station Area and The Boardwalk areas of the city. The applicant, Jonathan Tran, co-owner of DFW Indoor Pickleball (DIP), is seeking approval of a Zoning Amendment to add 4801 Spring Valley Road to the AB-OP overlay district to sell alcoholic beverages for consumption within the facility without having to be a Qualifying Restaurant as provided for in Article 2.6 of the CZO. DIP is located within suite 108 of 4801 Spring Valley Road. The subject property is located within the Planned Development District No. 27 (PD-27) zoning district. The subject property is not currently located within the AB-OP overlay district, hence an amendment to the CZO is required.
