Consider approving Resolution No. 2024-077 authorizing an amendment to the construction contract with Klutz Construction, LLC. for construction services relating to the Cooks Creek Channel Improvement Project, increasing the original contract by $51,793; and take appropriate action.

BACKGROUND:
On October 11, 2022, the City Council approved Resolution No. 2022-112, awarding Klutz Construction a contract for the Cooks Creek Channel Improvement Project totaling $4,567,384. The contract included replacing the concrete channel sloped wall and channel bottom along Cooks Branch between Bee Street and Spring Valley Road. The project aimed to reduce flooding along the creek by increasing the channel capacity. To do this, the contractor is replacing the trapezoidal channel wall throughout the project limits with a vertical channel.

The stretch of creek within the project limits is approximately 2,500 linear feet, as well as a 50-foot right-of-way area. The creek right-of-away abuts houses along Rugby Lane, Albemarle Drive, and Springvale Drive. Besides the channel replacement, the project included the replacement of both a 21" diameter sanitary sewer line that lies below the creek and the Spring Valley Road bridge.

DISCUSSION:
Since the approval, additional tasks have been identified and agreed to by both the Contractor and the Public Works Department for project completion. These include removing three additional trees to facilitate channel wall construction, repairing failing sections of the channel walls and bottom that require additional measures above and beyond typical replacement, and installing an additional culvert to widen and construct the Spring Valley Bridge. In addition to the culvert, the Spring Valley Bridge also required supplementary asphalt paving. Additionally, extra embedment was for sewer line construction to remediate excess groundwater conditions. The cost to complete these tasks is $51,793.
