Conduct a public hearing and consider adopting Ordinance No. 3310 amending the Comprehensive Zoning Ordinance, including but not limited to, amending Article 8 by establishing a new zoning overlay district (District 10) to allow for the sale of beer and wine for off-premise consumption located at 2702 Valwood Parkway and take appropriate action.

BACKGROUND:
In June of this year, the City of Farmers Branch passed Ordinance No. 3283 to allow beer and wine sales by right in nine (9) overlay districts throughout the City. City Administration reviewed all areas of the City that allow retail sales, as well as proximity to schools, neighborhoods and other land use activities to determine these overlay locations.
DISCUSSION:
The applicant's business, the Valero gas and convenience store, was not included in the nine (9) overlays and therefore seeks to amend the Comprehensive Zoning Ordinance to allow beer and wine sales at their individual site.
RECOMMENDATION:
On September 8, 2014, the Planning & Zoning Commission voted to recommend denial of the amendment to the Comprehensive Zoning Ordinance described in Ordinance No. 3310.
*Note: This zoning amendment request has received written opposition from more than 20% of the surrounding property owners and therefore requires a super majority vote of City Council (4 votes) in order to be successful as described in Article 24-101 (e) of the Comprehensive Zoning Ordinance.
