Consider approving Resolution No. 2013-036 authorizing the City Manager to enter into an agreement with Freese and Nichols for professional engineering services to identify and explore a possible storm water utility fee and take appropriate action.

BACKGROUND:
In accordance with the Texas Local Government Code 552, subchapter C, the City of Farmers Branch is required to manage a storm water program. The Federal and State governments have established guidelines and reporting requirements for this program and passed those unfunded mandates on to the local municipal authorities. The program has requirements to map the storm drain infrastructure, inventory the system, meet regulatory compliance, operation and maintenance, reduction of pollution, public outreach, annual reporting, and more.

DISCUSSION:
The attached proposal will identify and explore some of the decisions for establishing a storm water utility fee. The plan is to take the City through a process of developing an inventory and capitol program. The next step will identify how much each parcel of land contributes to the whole and explore the potential impacts citywide. Based on the level of service desired, condition of the system, and capital projects identified a total cost will be calculated. From these steps, alternatives can be considered and public meetings will be held to seek input from the stakeholders. From this process a likely solution will be identified and brought back for consideration.

RECOMMENDATION:
City Administration recommends approving Resolution No. 2013-036 authorizing the City Manager to enter into an agreement with Freese and Nichols for professional engineering services to identify and explore a possible storm water utility fee in an amount not to exceed $122,110.00.
