Title
Conduct a public hearing and consider adopting Ordinance No. 3283 amending the Comprehensive Zoning Ordinance to establish a new zoning district called Beer and Wine Sales Overlay District and take appropriate action. This new district will allow for the sale of beer and wine for off-premise consumption and establish new regulations and definitions for controlling this new land use.

BACKGROUND:
On May 10, 2014 the citizens of Farmers Branch voted to allow the sale beer and wine for off-premise consumption within the City. This will allow businesses to sell packaged and sealed beer and wine, ranging from a single can or bottle to a sealed keg. With this community decision, City staff felt it was necessary to amend the existing land use controls for this activity to better meet the shopping needs of the future consumers. The creation of a new "Beer and Wine Sales Overlay District" was the preferred zoning technique by City Administration, the Planning & Zoning Commission, and City Council. In determining these 11 proposed Beer and Wine Sales Overlay districts, City staff reviewed all areas of the city that allow retail sales, as well as proximity to schools, neighborhoods and other land use activities.

RECOMMENDATION:
At the May 29, 2014 regular meeting, the Planning & Zoning Commission voted to recommend approval of this amendment to the Comprehensive Zoning Ordinance establishing a new zoning district called "Beer and Wine Sales Overlay District" and the creation of 9 Beer and Wine Sales Overlay Districts throughout the City.

This P&Z recommendation modified the original proposed ordinance by eliminating proposed Zone 3 and Zone 6 and reducing the boundaries of Zone 4 to only the area within the block bounded by Maybrook, Webb Chapel, LBJ Freeway and Treeview.
