Consider adopting Ordinance No. 3286 amending the Code of Ordinances, Chapter 46, by adopting Section 46-2 "Prohibition of Beer and Wine in Residential Areas" and take appropriate action.

BACKGROUND:
On May 10, 2014 the citizens of Farmers Branch voted to allow the sale of beer and wine for off-premise consumption within the City. This will allow businesses to sell packaged and sealed beer and wine, ranging from a single can or bottle to a sealed keg. With this community decision, City Administration felt it was necessary to amend the existing land use controls for this activity to better meet the shopping needs of the future consumers. To that end, the City is establishing a new "Beer and Wine Sales Overlay" within the Comprehensive Zoning Ordinance. All of these proposed overlay districts are located in commercial zoning areas of the City, and not in residential neighborhoods. To prevent the potential sale of beer and wine within our residential neighborhoods the City has also prepared an amendment to Chapter 46 of the City Code of Ordinance prohibiting the future sale of packaged beer and wine within residential areas.  Ordinance No. 3286 is this amendment to Chapter 46 of the Code of Ordinances.
 
RECOMMENDATION:
City Administration recommends adopting Ordinance No. 3286.
 
ACTIONS:
1)      Motion to adopt Ordinance No. 3286 amending the Code of Ordinances, Chapter 46, by adopting Section Section 46-2, prohibiting the sale of beer and wine in residential areas.
2)      Motion to deny Ordinance No. 3286 amending the Code of Ordinances, Chapter 46, by adopting Section Section 46-2, prohibiting the sale of beer and wine in residential areas.
3)      Motion to modify to meet the needs of the Council.
4)      Motion to table the issue for further study or take no action.
