Consider approving Resolution 2017-007 authorizing City Manager to execute a second contract amendment with Camelot Landfill TX, LP for an annual $93,000 payment to the City of Lewisville and once per month free residential dropoff at Camelot Landfill for Lewisville residents; and take appropriate action.

BACKGROUND:
During the 2015 Texas Legislative session, House Bill 281 prohibiting the Texas Commission on Environmental Quality from issuing a permit amendment for Camelot Landfill to the City of Farmers Branch without first obtaining approval from the City of Lewisville. The City of Lewisville required Farmers Branch to submit a zoning application request and agree to certain environmental and financial provisions.
One provision is a $93,000 annual payment to the City of Lewisville. The payment amount is equivalent to what Waste Management and Republic Services pay to the City of Lewisville annually for events and Keep Lewisville Beautiful support.
Another provision is once per month free disposal for Lewisville residents at Camelot Landfill after Waste Management’s DFW Landfill closes. The free residential drop off was in exchange for protected tree mitigation payments that would have been due to Lewisville during the zoning application review process, as a result of future landfill operations that will expand into heavily wooded areas resulting in the clear cutting of thousands of protected trees per the City of Lewisville Code of Ordinances. Based on the currently permitted waste disposal capacity and waste acceptance rates, the DFW Landfill has approximately 8-10 years of life. Currently, Lewisville residents have this allowance at DFW Landfill. To qualify, free disposal would occur when a resident transported waste material in his or her personal vehicle to the landfill. This is a typical stipulation in residential collection contracts. Camelot Landfill TX, LP was given copies of the agreement with the City of Lewisville for their internal review.
DISCUSSION:
City staff negotiated with Camelot Landfill TX, LP, a wholly owned subsidiary of Republic Services and the landfill operator, to Lewisville $93,000 annually. This contract amendment details the payment terms and schedule. In addition, staff negotiated the free residential disposal with Republic Services, which offsets the cost of the tree mitigation payments that would have been due in the 2017 per Lewisville development ordinance requirements.
RECOMMENDATION:
City Administration recommends approving Resolution No. 2017-007 authorizing the City Manager to execute the contract amendment with Camelot Landfill TX, LP, and take appropriate action.

1. I move to approve Resolution No. 2017-007 authorizing the City Manager to execute the second contract amendment with Camelot Landfill TX, LP.
