Title

Consider approving Resolution No. 2017-029 accepting the preliminary service and assessment plan and assessment roll for the levy of assessments for authorized improvements in the Mercer Crossing Public Improvement District in the City of Farmers Branch; setting a date for public hearings; authorizing the publication of notice; and enacting other provisions relating thereto; and take appropriate action.

 

Body

BACKGROUND:

Chapter 372 of the Texas Local Government Code, the “Public Improvement District Assessment Act” (as amended, the “PID Act”), governs the creation and operation of public improvement districts within the State of Texas.  The attached Mercer Crossing Public Improvement District preliminary Service and Assessment Plan (the “Service and Assessment Plan”) has been prepared in accordance with the PID Act. Resolution No. 2017-029 provides for the acceptance of the preliminary Service and Assessment Plan and related Assessment Roll.

 

The Service and Assessment Plan includes:

 

                     Plan Description

                     Property included in the PID

                     Description of Improvements

                     Service Plan

                     Assessment Plan & Terms

                     Assessment Roll

                     Assessment Methodology and Allocation

 

Resolution No. 2017-029 also calls for setting a public hearing on March 1, 2017, at 6 p.m. at Farmers Branch City Hall for the City Council to consider approving the preliminary Service and Assessment Plan and related Assessment Roll as the final Service and Assessment Plan and related Assessment Roll.

 

DISCUSSION:

Resolution No. 2017-029 provides for the acceptance of the preliminary Service and Assessment Plan and related Assessment Roll and for calling a public hearing on March 1, 2017 to consider final approval.

 

RECOMMENDATION:

City Administration recommends approving Resolution No. 2017-029.

 

POSSIBLE COUNCIL ACTION:

1. Motion to approve Resolution No. 2017-029, as presented.

2. Motion to approve Resolution No. 2017-029, with the following modifications.

3. I move to table the issue for further study or take no action.
