Title

Consider adopting Ordinance No. 3539 amending Code of Ordinances Chapter 2, “Administration,” Article IV, “Public Records” by repealing Division 2, “Access” relating to the public’s access to public information and repealing Ordinance No. 2793; and take appropriate action.

 

Body

BACKGROUND:

The City Council adopted Ordinance No. 1619 (1986), Ordinance No. 2793 (2004), which were codified into City Code setting procedures of processing open records, and setting costs to obtain and access City records.  However, many of these methods are outdated and not in alignment with the Texas Public Information Act.  The proposed Ordinance No. 3539 provides costs and allows the public access with the provisions of the Texas Public Information Act.       

 

DISCUSSION:

Since the State governs the cost of records associated with obtaining an open records request through the Texas Public Information Act, Ordinance No. 3539, repeals Chapter 2, Article IV Public Records, Division 2 Access, in its entirety, and brings the City into compliance with the Texas Public Information Act (PIA).   

 

FISCAL IMPACT:

RECOMMENDATION:

City Administration recommends the City Council adopt Ordinance No. 3539, as presented.
