Consider adopting Ordinance No. 3544 approving a boundary adjustment agreement with the City of Farmers Branch and the Town of Addison; and take appropriate action

BACKGROUND:

The City of Farmers Branch and the Town of Addison both share ownership of a portion of Midway Road.  The City currently has jurisdiction over one lane on Midway Road and the Town of Addison has jurisdiction on the remaining portion.  The Town of Addison has approached the City requesting a boundary adjustment to provide them with jurisdiction over traffic enforcement and maintenance of Midway Road.

DISCUSSION:

Since the City of Farmers Branch owns and enforces a single lane on Midway and the Town of Addison owns and enforces the remaining lanes, the City has agreed to adjust the boundary and release the designated area to the Town of Addison.  There is no impact on residents or ad valorem tax loss to the City.  The Town of Addison has agreed to maintain the entire pavement on Midway Road and will have jurisdiction over traffic enforcement, operation and maintenance of the public street.  The City of Farmers Branch will own and maintain the public utilities under the pavement of the Farmers Branch Midway within the released area.

RECOMMENDATION:

City Administration recommends adopting Ordinance No. 3544, as presented.
