BACKGROUND:
City staff presented the current city smoking ordinance as well as ordinances of neighboring cities during the November 27, 2018 City Council Study Session.
DISCUSSION:
Based on guidance from City Council, the proposed Ordinance No. 3551 amends the current Code of Ordinances by providing an updated definition of smoking to include use of e-cigarettes. It amends the list of places where smoking is prohibited to include any property owned, leased, or otherwise operated by a governmental entity as a public park or recreational facility, with the exception of designated areas and in personal vehicles where the windows are closed.

City Administration recommends adopting Ordinance No. 3551, adopting Ordinance No. 3551, amending Code of Ordinances Chapter 34, “Environment,” Article III “Air Pollution” by amending Section 34-142 “Definitions”; Amending Section 34-143 “Prohibited in Certain Public Areas” by prohibiting smoking in public parks; providing a penalty.
