Consider adopting Ordinance No. 3555 abandoning and quitclaiming all rights, title and interest in a utility easement located within a portion of Lot 1, Block A, Trinity East Addition; and take appropriate action.

BACKGROUND:
The City of Farmers Branch has been requested to abandon all portions of an existing utility easement retained per City Ordinance No.1456 where the City vacated its interest in Edna Lane for use as a public street, but retained it as a public utility easement.
DISCUSSION:
The Public Works Department has determined that said easement shown in Exhibit “A” is not needed now or in the future. The Developer is pursuing the release of the utility easement as part of a proposed commercial development in the overall west side development project. Upon approval of Ordinance No. 3555, the City Manager will execute and deliver a Release and Quitclaim of Easement to be recorded by the property owner, affecting a full release of the City’s rights to the easement.

City Staff recommends approval of Ordinance No. 3555 abandoning the said utility easement within

1. I move to approve adopting Ordinance No.3555 abandoning and quitclaiming all rights, title and interest in a utility easement located within a portion of Lot 1, Block A, Trinity East Addition
2. I move to approve adopting Ordinance No.3555 abandoning and quitclaiming all rights, title and interest in a utility easement located within a portion of Lot 1, Block A, Trinity East Addition with modifications.
3. I move to table the issue for further study or take no action.
