Consider adopting Ordinance No. 3564, amending Code of Ordinances Chapter 34, Article III by amending Section 34-143 by prohibiting smoking in public places; and take appropriate action

 

Body

BACKGROUND:

City staff presented the current city smoking ordinance as well as ordinances of neighboring cities during the November 27, 2018 City Council Study Session. In January, City Council amended the ordinance to expand the definition of “smoking” to include use of e-cigarettes and to ban smoking in all city owned facilities and parks.

 

Following that change, a postcard was sent to all Farmers Branch businesses requesting input on proposed further changes to the smoking ordinance that would expand the prohibition of smoking in public places and buildings. Staff received feedback from two individuals; one from a restaurant owner in support of the ordinance change and one from a business employee opposing it. No other feedback was received from businesses or restaurants.

 

 

DISCUSSION:

Based on guidance from City Council, the proposed Ordinance No. 3564 modifies the current Code of Ordinances to amend the list of places where smoking is prohibited to include any public places, including restaurants, with the exception of four locations. Proposed change will take effect on October 1, 2019.

 

FISCAL IMPACT:

RECOMMENDATION:

City Administration recommends adopting Ordinance No. 3564 etc.

 

POSSIBLE COUNCIL ACTION:

1. I move to approve Ordinance No. 3564, as presented.

2. I move to approve Ordinance No. 3564, with modifications.

3. I move to table the issue for further study or take no action.
