BACKGROUND:
The Texas Legislature has enacted Texas Local Government Code §214.907 prohibiting cities from considering the value or cost of construction of the construction or improvement of a residential dwelling when establishing building permit fees, which law became effective May 21, 2019
DISCUSSION:
With significant residential development occurring on the West side coupled with the September 2017 changes to our permit fee structure, staff has proposed a square footage-based fee structure amendment to Appendix A. This amendment will address the new rules of H.B. 852 and keep the subsequent residential permit fees generated as a result of the amendments, revenue neutral.
