BACKGROUND:
The Comprehensive Zoning Ordinance allows a "Temporary Carnival or Circus" in all zoning districts if prior approval is granted by passage of a resolution of the City Council for such use.

A request was submitted by Mary Immaculate Catholic Church, located at 2800 Valwood Parkway, requesting permission to host their 2021 Annual Fall Festival on October 2, 2021 which will include the use of an outdoor amplified PA system. This year's event will offer the following activities:

* Market Vendor - pop-up tents outside on church parking lot and inside Parish Hall.
* Food Trucks - offered on church parking lot alongside seating areas in and around big top tent.
* Performances within big top tent and open parking lot.
* Raffle - online sales and sales contest by ministries. Raffle prizes to be distributed via curbside and office pick-up post festival date.
* Silent Auction Baskets - online sales and distribution via curbside and office pick-up post festival date.
* Miscellaneous Activities - pumpkin painting, small children's games, pony rides, petting zoo and/or mechanical train within open and tented areas in church parking lot and on grass.

DISCUSSION:
Last year, approval was granted to host the Fall Festival, with a provision in the resolution allowing for the use of an outdoor amplified PA system until 9:00 p.m. on Saturday. The same provision has been included in the proposed resolution. This provision does not allow the event to violate the City's Noise Ordinance, which provides that "no person shall make or cause to be made any unreasonably loud, disturbing and unnecessary noise in the City which is offensive to the ordinary sensibilities of the inhabitants of the city..."
