Consider adopting Ordinance No. 3705 amending the Code of Ordinances, Amending in its Entirety Chapter 66 “Solid Waste” Relating to Regulation of the Collection and Disposal of Solid Waste and Recyclable Materials; and take appropriate action

BACKGROUND:

In April 2021, the City offered residents living east of I-35 a chance to participate in a pilot program for the use of vendor-supplied carts for garbage collection. Due the success of the program, all residents living in single-family homes will now have the option to use garbage carts going forward. However, the current ordinance prohibits the use of personal or vendor-supplied carts for garbage collection for residences east of I-35. In addition, recent changes to the Code of Ordinances, Chapter 56. Property Maintenance, changed the screening requirement for vendor owned rollout carts. Chapter 66 needs to mirror this language to avoid conflict between the chapters of the City’s Code of Ordinances. Finally, staff has faced challenges with different commercial entities within Farmers Branch regarding insufficient size or service for dumpsters and the containment of solid waste within the dumpster or solid waste container.

 

DISCUSSION:

The proposed amendments to the Chapter 66 would address the described issues. The ordinance removes the prohibition of using a cart for garbage storage and collection for any single family home in Farmers Branch. Carts are only required for single family residences in Planned Districts 99 and 100. For the rest of the city, residence may use a vendor supplied cart or disposable containers that comply with the existing definition in Chapter 66. In addition, cart screening requirements will refer to Chapter 56. Property Maintenance, so there is no conflict between the two chapters. Finally, Section 66.10 was added to the ordinance to provide regulations for the storage and service frequency of garbage and recycling containers at commercial establishments in Farmers Branch. The new section also provides regulations regarding solid waste spilled and vehicle fluid cleanup for collection at locations not covered by the residential and municipal facilities contract with Community Waste Disposal.

City Administration recommends adopting Ordinance 3705 amending Chapter 66. Solid Waste.
