Title

Consider adopting Ordinance No. 3708 amending the Code of Ordinances Chapter 56, the Property Maintenance Code, to include a new exemption for parcels used for cropping purposes from certain mowing and outside storage requirements of Chapter 56; and take appropriate action

 

Body

BACKGROUND:

 

On August 3, 2021, the City Council approved Ordinance No. 3696 repealing and replacing the existing Chapter 56 of the Code of Ordinances also known as the Property Maintenance Code. Since the passage of Ordinance No. 3696, the Council has considered creating an exemption for certain properties within the City that are used for genuine farming / cropping purposes.

 

The exemption being considered today in Ordinance No. 3708 would eliminate the mowing requirement found in Chapter 56 Section 56-51(a) for parcels meeting specific criteria as established by Ordinance No. 3708. This ordinance would also create a new defense to prosecution for the outside storage of hay bales meeting certain criteria.

 

RECOMMENDATION:

Staff recommends approving Ordinance No. 3708 as presented.

 

POSSIBLE COUNCIL ACTION:

1. I move to approve Ordinance No. 3708 as presented.

2. I move to approve Ordinance No. 3708 with modifications.

3. I move to table the issue for further study or take no action.
