Consider approving Resolution 2022-105 establishing a moratorium on tree stump enforcement.

BACKGROUND:
On August 2, 2022, during a regularly scheduled Study Session, Leo Bonanno, Deputy Director of Neighborhood Services announced that the Code Enforcement Division would be initiating a City-wide enforcement plan for tree stumps and dead trees.
The City’s Property Maintenance Code (Chapter 56) currently requires that all dead trees be removed from properties and that all tree stumps be cut to a height no taller than 6 inches above grade level.
During the August 2nd meeting, the Council expressed differing views over the handling of stumps existing prior to the passage of Chapter 56. The tree stump inventory is attached. A moratorium was suggested to allow the Code Enforcement Division to proceed with its enforcement plan on dead trees, which all agreed are a safety hazard, while allowing the Council more time to discuss stump enforcement.
DISCUSSION:
The purpose of today’s discussion is for Council to determine an expiration date for the tree stump enforcement moratorium. Staff will be available to answer questions.
