Consider approving Resolution No. 2024-041 authorizing the City Manager to execute Change Order No. 2 for the design-build contract for the Multisport Facility with Lee Lewis Construction Inc., allowing for the construction of a parking lot, fire lane, and utilities in the amount of $1,486,459.00; and take appropriate action.

BACKGROUND:
In 2022, the City awarded a design-build contract to Lee Lewis Construction Inc. (LLCI) to design and construct a multisport facility on city-owned land near Pike Street and IH-35 frontage road. Since the December 2022 approval, the City and LLCI have worked on final designs, site plan approvals, final pricing, and acquiring Texas Department of Transportation (TxDOT) surplus land. The design-build contract A141 document approved in December 2022 between the City and LLCI has a maximum price of $23,355,161. In January 2024, Change Order No. 1 was approved and executed to allocate funds for the interest that had occurred since the beginning of the project. Change Order No. 2 will allow for the construction of the parking lot and associated civil infrastructure as intended initially; the change order moves this infrastructure to LLCI instead of a separate builder and keep the totality of the project under one firm.

DISCUSSION:
Change Order No. 2 is a cost increase for the contract, which includes the construction of a parking lot, fire lane, and utilities. This original scope of work for the AIA Agreement with Lee Lewis included these items. This change order allows for the completion of the public infrastructure portion of this project in alignment with the plan originally shared with the Council.

FISCAL IMPACT:
The budgeted financial impact on the Pike Street Bond Fund is $1,486,590.
