BACKGROUND:
In October 2018 City forces, in conjunction with affected property owners, discovered unstable erosion conditions as the result of dam failures on Farmers Branch Creek west of Mallon Park. After investigating it was found that due to the excessive rainfall in the month of September, there were multiple dam failures reported along Farmers Branch Creek between Josey Lane and Ford Road. These failures resulted in significant erosion risks and threaten homes and infrastructure.

DISCUSSION:
Public Works immediately contracted with Freese and Nichols to conduct a site risk assessment for the conditions of Farmers Branch Creek due to the dam failures. The evaluation provided for a short-term, but immediate, emergency stabilization solution. City Administration found it to be in the public's safety need to repair and prevent further damage and erosion along Farmers Branch Creek. The City Manager directed the Public Works Director to execute a purchase requisition for the emergency repairs of the dam collapse and other erosion problems along Farmers Branch Creek with Rebcon, Inc. Staff engaged Rebcon, Inc. due to their expertise in making such repairs, having the appropriate equipment and being availabile.

FISCAL IMPACT:
Budgeted Financial Impact $167,000 from the 2018-2019 Municipal Utility Drainage Fund.

RECOMMENDATION:
The Public Works Director recommends adopting Resolution No. 2019- 022 ratifying an emergency contract with Rebcon, Inc. for repairs due to dam failures and other emergency necessary repairs along Farmers Branch Creek in the amount of $167,000.
